1. Acceptance of Terms

By accessing or using the Mobile Diesel USA website and platform, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services. These terms apply to all users, including truck drivers, fleet managers, and mobile diesel mechanics.

2. Platform Description

Mobile Diesel USA is a technology platform that connects truck drivers and fleet operators with independent mobile diesel mechanics. We facilitate the dispatch process but do not directly perform repair services. Mechanics on our platform are independent contractors, not employees of Mobile Diesel USA.

3. User Responsibilities

For Truck Drivers & Fleets

  • Provide accurate vehicle and location information when requesting service
  • Ensure a safe working environment for the dispatched mechanic
  • Pay for authorized services in a timely manner
  • Communicate any known hazards or special conditions at the service location

For Mechanics

  • Maintain valid licenses, insurance, and certifications
  • Provide accurate information about qualifications and experience
  • Perform services professionally and in accordance with industry standards
  • Communicate honestly about repair estimates, timelines, and parts needed
  • Maintain appropriate tools, equipment, and a safe service vehicle

4. Service Requests & Dispatch

Service requests submitted through our platform are matched with available mechanics based on location, availability, and specialization. Mobile Diesel USA does not guarantee response times, mechanic availability, or specific repair outcomes. We strive to provide fast, reliable dispatch but cannot be held liable for delays caused by traffic, weather, parts availability, or other factors beyond our control.

5. Requests Made Through AI Assistants

You can send a repair request through an AI assistant such as ChatGPT. These terms apply to that request exactly as they do to a request made on our website or by phone. In addition:

  • A request is not a confirmed booking. A dispatcher reviews it and contacts you to confirm the location and availability before any mechanic is assigned. Until you hear from us, do not assume a mechanic is on the way.
  • Service area. Dispatch covers the Phoenix, Arizona metro area today. Requests for other places are declined.
  • No payment and no estimate in the assistant. No payment is taken through an assistant. The mechanic diagnoses the truck on site and quotes before any work begins, and you approve the quote first.
  • Check the details. You are responsible for the details you, or the assistant on your behalf, send us. We confirm them with you before anyone is dispatched.
  • Cancelling. You can cancel through the assistant until a mechanic is assigned, at no cost. After that, call dispatch.
  • The assistant is someone else's service. It is provided by another company under its own terms. We do not control it or what it says, and we are not responsible for prices, arrival times, or coverage that an assistant states but we did not publish.
  • Emergencies. If anyone is in danger, call 911. Do not use an assistant or this service for an emergency.

6. Payments & Fees

Repair costs are determined between the mechanic and the customer. Mobile Diesel USA may charge platform fees for facilitating the connection. All payment terms, including diagnostic fees, labor rates, and parts costs, should be agreed upon between the mechanic and customer before work begins. Disputes regarding pricing should be directed to Mobile Diesel USA support for mediation.

7. Limitation of Liability

Mobile Diesel USA is a dispatch platform and does not perform repair services directly. To the fullest extent permitted by law, Mobile Diesel USA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our platform, including but not limited to damages from repair work performed by mechanics, vehicle downtime, or lost revenue. Our total liability shall not exceed the platform fees paid by you in the preceding 12 months.

8. Intellectual Property

All content on the Mobile Diesel USA website, including text, graphics, logos, images, and software, is the property of Mobile Diesel USA and protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works from our content without prior written permission.

9. Account Termination

We reserve the right to suspend or terminate your access to the platform at our discretion, including for violations of these terms, fraudulent activity, or behavior that harms other users or the platform. Mechanics may be removed from our network for failing to maintain required credentials, consistent negative reviews, or unprofessional conduct.

10. Dispute Resolution

Any disputes arising from these terms or your use of the platform shall first be addressed through good-faith negotiation. If resolution cannot be reached, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Class action claims are waived to the fullest extent permitted by law.

11. Modifications

We may modify these Terms of Service at any time. Changes will be posted on this page with an updated date. Continued use of the platform after changes constitutes acceptance of the modified terms. We encourage you to review these terms periodically.
